Alina Habba has left her position as the chief federal prosecutor in the state. This comes after a judicial decision that questioned her eligibility to occupy the role.

The nation's top law enforcement official, Pam Bondi, confirmed her stepping down on the start of the week. In a statement that the appeals court finding made it "untenable" for the official to effectively run her office.
"But do not mistake following the order as giving up," Habba stated. "The effort will now extend throughout the nation."

The departure comes a week after a judicial panel found that she had been serving in violation of the law as US attorney. This judgment is expected to impact scores of criminal cases in the Garden State.
The judicial panel ruled that a acting appointment that bypassed the advice and consent of the Senate ran afoul of the statute on vacant positions.
Future Role and Reaction
It was also stated that the former prosecutor will continue working within the Department of Justice as a senior adviser. Habba plans to seek further review of the disqualification, aiming for a different outcome.
Writing online, Bondi argued that the judiciary "must not override the appointment of attorneys responsible for carrying out the executive branch's core responsibility of enforcing the law."

The attorney general highlighted her tenure and noted that while she was in charge, the Newark saw a significant drop in criminal activity. She also stated that the southern city of Camden had its initial homicide-free summer since 1974 with no murders.
Background and Previous Role
The 41-year-old attorney, was initially recruited to the former president's legal defense in 2021. She later defended her client in his hush-money trial in 2024, when he was conviction on multiple felony counts of document fraud.
Prior to her appointment to the top New Jersey post, Trump had revealed he was selecting her as his presidential counsellor in a potential future term, calling Habba as "unwavering in her loyalty" and a "tireless advocate for justice".
