Federal Judge Mandates Freedom of Abrego Garcia from Immigration Custody
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks legal authority.
"Since his return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case stems from a erroneous removal to El Salvador in March, which US authorities later admitted was an error. Following his repatriation to the United States to answer alien smuggling charges, he was held in federal detention.
In her decision, the court pointed out that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

The legal challenge center on disputed claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.
He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing criminal case in the state of Tennessee.
